Sajjan Kumar summoned in 1984

NEW DELHI:
Twenty-five years after 12 Sikhs were murdered in Sultanpuri and
Delhi Cantonment in the 1984 genocide of the Sikhs, a city court
last Monday issued summons to former MP Sajjan Kumar.
Taking
cognisance of chargesheet filed in two cases of killings, the
Additional Chief Metropolitan Magistrate said, "A case is made out
against Kumar under sections of murder and rioting."
The judge has
directed the Congress leader and other accused in the case to appear
before him on February 17.
In the FIR
registered at Sultanpuri police station, the CBI has also charge
sheeted accused Ved Prakash, Peeru, Kushal Singh and Brahma Nand
Gupta, apart from Sajjan Kumar.
And in the FIR
registered at Delhi Cantonment, the accused are Balwan Khokar,
Mahender Yadav, Kishan Lal Khokar, Saroj, captain Bagmal and
Mahender Yadav.
On January 13,
the CBI had filed two chargesheets accusing Kumar and others for
murder and rioting.
The court noted
that despite pressing murder charges against Kumar; the CBI never
arrested him.
The counsel for
victims, H.S. Phoolka, has sought immediate arrest of Kumar, saying
he could influence the witness and tamper with the evidence.
The judge turned
down Phoolka's plea stating, "For the past 25 years, Kumar has been
residing in the same locality and he has never changed his address."
"He has never
evaded arrest. Then why issue a non-bailable warrant against him?"
The court also noted that no witness has apprehended any threat from
Kumar or registered any complaint against him, during the trial.
The CBI had
filed the chargesheets after concluding investigation into the cases
registered on the recommendation of the Nanavati Commission in 2005.
The commission
had inquired into the sequence of events leading to the 1984
killings of the Sikhs.
Eleven witnesses
recorded their statements before the magistrate out of which two
recorded their statements in Amritsar.
