SC contempt notice to Punjab
Chandigarh:
India's Supreme Court has issued a showcause notice to
Punjab
asking it to explain as to why contempt proceedings be not initiated
against it for violating the court’s directions.
The notices have
been issued on a petition filed by S S Virk, former Punjab Director
General of Police (DGP), in which he has accused the government of
violating Supreme Court directions. The court had directed the
government to hand over the entire case file of Virk to the Centre.
The court in its
May 16, 2008 order had made it clear that it would be given only to
the Centre which would be competent to proceed against Virk.
It has been
alleged by the former DGP that despite clear directions of the SC,
the Punjab government is continuing departmental inquiry against
him.
The Punjab
government had suspended Virk on April 4, 2007 after Vijay Pal
Singh, an accused in a criminal case, said he had bought some land
in Virk’s name. The CAT on April 3, 2008 annulled Virk’s suspension,
while upholding the April 10, 2007 order of the Union government,
repatriating him to
Maharashtra.
The CAT had also
directed the state government to remit all incriminating materials,
if any, against Virk to the Centre for taking disciplinary action
against him.
But on a plea by
the state government, the
Punjab
and Haryana High Court had suspended the CAT order.
Subsequently,
the SC had granted relief to Virk on his appeal against the HC order
and upheld his repatriation to Maharashtra.
