Sessions Judge Rekha Mittal on Tuesday dismissed the anticipatory
bail application of former SGPC president Bibi Jagir Kaur, against
whom Anandpur Sahib Sub-Divisional Judicial Magistrate Jatinder Kaur
had issued non-bailable arrest warrants for her failure to appear in
court in connection with a case registered against her and 11 other
Akali leaders for violating prohibitory orders.
The court passed
the orders after hearing the arguments of Public Prosecutor Pradeep
Mehta and defence counsels on the anticipatory bail application
filed by Bibi Jagir Kaur a few days back.
The defence
counsels had argued that Bibi Jagir Kaur could not appear in the
Anandpur Sahib court on the date of hearing of the case against her
unintentionally and had noted down the wrong dates of hearing.
On the other hand,
Public Prosecutor Pradeep Mehta opposed the bail plea of Bibi Jagir
Kaur, saying she had not even submitted any request for exemption
from personal appearance in the court on July 2 and September 15.
Bibi Jagir Kaur
and other Akali workers had been booked under Section 188 of IPC for
violating the orders issued under Section 144 of CrPC by leading a "jatha"
of Akali workers from Anandpur Sahib to Rupnagar district courts
where Badal was to appear in connection with a disproportionate
assets case against him and others on December 1, 2003.
