Former Secretary-cum-Director of Industries and Commerce Vijay Kumar
Janjua, who was arrested in a corruption case, has filed a criminal
complaint and a defamation suit against Ludhiana industrialist Tulsi
Ram Mishra for "filing a false complaint" against him with an
"intent to injure reputation".
The Vigilance
Bureau had arrested Janjua, a Punjab-cadre IAS officer, for
allegedly accepting Rs 2 lakh as bribe from Mishra in his office at
Udyog Bhawan on November 9 with a promise to allot him a vacant plot
in the industrial area in Ludhiana.
After Janjua's
arrest, the state government had placed him under suspension. The VB
then claimed that Mishra had struck the deal for allotment of the
plot with Janjua for Rs 5 lakh.
Janjua filed the
complaint under sections 193 and 211 of IPC for fabricating and
giving false evidence and for making false charges with the intent
to injure reputation. Janjua also filed a defamation suit against
Mishra under section 200 of Criminal Procedure Code (CrPC).
Janjua claimed
that Mishra had submitted an affidavit to the Chief Minister in
which he had made "false, malicious and libelous allegations"
against him without any basis. "When an inquiry was held, I
requested the enquiry officer to give me an opportunity to
cross-examine Mishra, which was never granted."
Janjua claimed
though the Chief Secretary gave an opportunity to Mishra to prove
the charges, he did not appear before him. "The inquiry was finally
filed at the level of the Chief Minister with observations that this
vexatious complaint was made with a motive to harass me".
He said when
Mishra came to know that he was contemplating filing a complaint
against him in a criminal court for filing a false affidavit, "he
entered into a conspiracy with Punjab Vigilance Bureau and got me
implicated in an illegal and false trap case".
